This Privacy Notice describes how MaterMacc Srl collects, uses and protects personal data of users of its website and services, in accordance with Regulation (EU) 2016/679 ("GDPR").

MaterMacc processes personal data in compliance with the principles of lawfulness, fairness, transparency, purpose limitation, data minimisation, accuracy, integrity and confidentiality, as required by the GDPR.

2. Purpose of this Notice

This Notice is provided pursuant to Article 13 GDPR and explains how personal data collected through the website and/or application are processed, including data provided to:

  • use the Company's services;
  • request information;
  • subscribe to the newsletter;
  • contact customer support;
  • participate in promotions or surveys.

3. Types of personal data processed

3.1 Browsing data

The IT systems and software procedures that enable the website to function acquire, during their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols. Such data are not collected to be associated with identified data subjects, but could allow the identification of users through processing and association with data held by third parties.

These data include, by way of example:

  • IP addresses or domain names of devices used;
  • URI addresses of requested resources;
  • time of the request;
  • method used to submit the request to the server;
  • size of the file obtained in response;
  • numerical code indicating the status of the response from the server;
  • parameters relating to the operating system and IT environment of the user;
  • session start and end time information.

Purpose and legal basis

The data are processed to:

  • ensure the proper functioning and security of the website;
  • obtain anonymous statistical information on website usage;
  • ascertain liability in case of computer crimes against the website.

The processing is based on the legitimate interest of the Controller, consisting in ensuring security, proper functioning of the website and improvement of services offered, without prejudice to the fundamental rights and freedoms of the user.

Retention period

Browsing data are retained for a maximum period of 1 year and in any case not beyond the decommissioning of the platform, except where required for investigation purposes.

Provision of data

The provision of browsing data is automatic and necessary for the use of the website.

3.3 Contact requests

The optional, explicit and voluntary provision of personal data by the user through:

  • the completion of contact forms;
  • sending communications via email or ordinary mail to the addresses indicated on the website;

entails the acquisition of personal data necessary to manage and respond to user requests.

Purpose and legal basis

The processing is aimed at responding to the data subject's requests. The legal basis is the performance of pre-contractual or contractual measures.

Retention period

Data are retained for the time necessary to manage the request and, in any case, not beyond 1 year from it.

Provision of data

The provision of data is necessary to enable the Company to respond to user requests.

3.4 Registration and access to restricted area

The Company collects personal data to allow user registration and access to the restricted area of the website, where it is possible to store information such as field mapping, agricultural machinery registration data and sowing data.

Such data are processed as personal data only to the extent that they are attributable, directly or indirectly, to an identified or identifiable natural person.

Purpose and legal basis

The processing is aimed at allowing access and use of the restricted area. The legal basis is the performance of a contract.

Retention period

Data are retained until termination of the contractual relationship and, in any case, not beyond the decommissioning of the platform.

Provision of data

The provision of data is necessary for registration and access to the restricted area.

3.5 Marketing and newsletter

Users may optionally subscribe to the MaterMacc newsletter to receive commercial and promotional communications.

Purpose and legal basis

The processing is aimed at sending marketing communications and is based on the consent of the data subject.

Retention period

Data are processed until the user withdraws consent.

Users may withdraw consent at any time by contacting the Controller.

Provision of data

The provision of data is optional.

4. Processing methods and data recipients

The processing of personal data is carried out using manual, computerised and electronic tools, adopting technical and organisational security measures appropriate to the level of risk, such as, by way of example, authentication systems, access control, backup procedures and data protection.

The processing may be carried out, in addition to the Controller, also by third parties acting as Data Processors pursuant to Article 28 GDPR (for example IT service providers, hosting providers, newsletter services and technical support), duly appointed by the Company.

Data are processed for the time strictly necessary to achieve the purposes for which they were collected and in accordance with legal obligations and provisions of competent authorities.

Personal data are mainly processed within the European Economic Area (EEA). Where, for technical or operational needs, data need to be transferred to countries outside the EEA, the transfer will take place in compliance with Articles 44 et seq. of the GDPR, on the basis of adequacy decisions of the European Commission or through appropriate safeguards (such as Standard Contractual Clauses).

5. Data subject rights

Notice for website forms

In the contact forms on the website, the processing of personal data takes place exclusively to respond to user requests. Before submitting the form, the Privacy Notice is made available through a dedicated link. Submission of the form implies acknowledgment of the Notice, without the need to provide specific consent.

Data subjects may exercise at any time the rights recognised by the GDPR, including:

  1. Right to information – to obtain clear and transparent information on the processing of personal data.
  2. Right of access – to obtain confirmation of the existence or not of processing and access to one's own data.
  3. Right to rectification – to request the correction of inaccurate or incomplete data.
  4. Right to erasure (right to be forgotten) – to request the deletion of data in the cases provided for by law.
  5. Right to restriction of processing – to obtain the restriction of the use of personal data.
  6. Right to data portability – to receive one's own data in a structured and readable format and transfer them to another controller.
  7. Right to object – to object to the processing of data, in particular for direct marketing purposes.
  8. Right to lodge a complaint – to lodge a complaint with the competent Data Protection Authority.
  9. Right to withdraw consent – to withdraw at any time previously given consent, without prejudice to the lawfulness of processing carried out before withdrawal.
